This is going to sound really strange coming from me, i.e., coming from someone who has been a life-long fairly radical devotee of the First Amendment, in particular, of both the Amendment’s religion clauses:  the “establishment” clause and the “free exercise” clause. But the recent publication of the grand jury’s findings regarding six Pennsylvania dioceses in the matter of priest pedophilia has caused me to radically reassess my attitude toward the latter clause, especially given  that two of the six dioceses in question attempted to have judges quash the grand jury proceedings. I must admit it feels really strange to be channeling Alan Dershowitz, not only because Prof. Dershowitz is still very much alive, but also because, at least on some issues, I share his oft-reviled ability to act as an honest broker by disinterestedly considering constitutional issues from the standpoint of both parties to a dispute.  But that is the position I find myself in while reading stories about and pondering the back and forth between Democrats / progressives and Republicans / conservatives regarding the matter of the confirmation of Supreme Court nominees Merrick Garland and Brett Kavanaugh. The “Vergangenheit” episode of season 2 of Netflix’ critically acclaimed series The Crown dwelt at length on the treachery of the ex-King Edward VIII’s and his wife Wallis Simpson’s collaboration with Hitler to restore Edward to the Throne following the supposedly imminent and, at the time, the all-too-possible fall of England and the establishment of a Nazi regime in the United Kingdom.
